These Terms of Use (“Terms”) govern your access to and use of ProjectME, a personal growth companion application (“Service”) provided by Philipp Tirtischni (“Provider”, “I”, “me”). By accessing the Service, you agree to these Terms.
ProjectME is currently in a closed alpha phase and is made available exclusively to personally invited testers at no charge. It is a non-commercial prototype, not a finished product.
1. Alpha Software — What This Means
You are using an early prototype. This is not a stable, production-ready application. By accepting these Terms, you expressly acknowledge and accept the following:
- Bugs and unexpected behavior may occur at any time.
- The Service may be unavailable, slow, or interrupted without prior notice.
- Your data (goals, journal entries, tasks, and other content) may be lost, corrupted, or deleted — including as a result of database resets at the end of the alpha phase.
- Features may be added, changed, or removed at any time without notice.
- The alpha phase may be terminated at any time without reason or replacement.
Do not rely on ProjectME for anything critical. No backups are guaranteed.
2. Eligibility & Access
Access to ProjectME during the alpha phase is limited to individuals who have received a personal invitation from the Provider. You may not share your invite link, login credentials, or access with others without explicit written permission from the Provider.
By using the Service, you confirm that you are at least 18 years old, or that you have obtained verifiable consent from a parent or legal guardian if you are under 18. The Service is not directed at children under 13.
3. No Commercial Relationship
ProjectME is provided free of charge during the alpha phase. There is no subscription, payment, or commercial agreement between you and the Provider. These Terms do not constitute a service contract or give rise to any claim for continued availability, feature completeness, or support.
4. Your Content
You retain ownership of all content you create within ProjectME, including goals, journal entries, and tasks (“User Content”). By using the Service, you grant the Provider a limited, non-exclusive, royalty-free right to store and process your User Content solely to operate and improve the Service.
You are solely responsible for your User Content. You agree not to submit content that is unlawful, harmful, or violates the rights of third parties.
5. Third-Party Services
The Service relies on the following third-party providers to function:
- Clerk – Authentication and session management
- Railway – Application hosting and database
- PostHog – Product analytics and error tracking (EU-hosted)
- Google – Optional sign-in via Google OAuth
- Unsplash – Stock images for goal visuals
These services operate under their own terms and privacy policies. The Provider is not responsible for the practices of third-party services.
Some of these providers may process data outside the European Economic Area (EEA). Where this is the case, appropriate safeguards apply as described in the Privacy Policy.
6. Analytics & Session Recording
The Service uses PostHog to collect anonymized usage analytics, including feature interactions, page views, and authentication events. Journal and goal text content is not tracked.
On Android, session replay is active and may capture UI interactions. The Provider takes reasonable steps to limit the capture of personal input, but cannot guarantee that no text input is ever recorded during a session replay. If this is a concern, you may use the web version instead.
7. Feedback
You are encouraged (though not obligated) to share feedback, bug reports, and ideas with the Provider via philipp.tirtischni@fnbsoftware-info.de. By submitting feedback, you grant the Provider an unrestricted, royalty-free right to use that feedback for any purpose, including improving the Service, without any obligation of compensation or attribution.
8. No Warranties
The Service is provided “as is” and “as available”, without warranty of any kind. To the maximum extent permitted by applicable law, the Provider expressly disclaims all warranties — express or implied — including but not limited to:
- merchantability or fitness for a particular purpose;
- uninterrupted or error-free operation;
- accuracy or completeness of any content;
- data integrity or preservation.
As the Service is provided free of charge, the Provider’s liability is limited pursuant to § 521 of the German Civil Code (BGB) to cases of intentional misconduct and gross negligence.
9. Limitation of Liability
To the fullest extent permitted by law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including data loss.
Nothing in these Terms limits liability for damages caused intentionally or by gross negligence, or for damages to life, body, or health.
10. Termination
The Provider may suspend or terminate your access to the Service at any time, for any reason or no reason, without notice and without liability. This includes termination of the alpha program as a whole.
You may stop using the Service at any time. To request deletion of your account and data, contact: philipp.tirtischni@fnbsoftware-info.de. Your data rights are further described in the Privacy Policy.
11. Changes to These Terms
The Provider may update these Terms at any time. In the case of material changes, reasonable notice will be given (e.g., by email or in-app notification). Continued use of the Service after the effective date of updated Terms constitutes acceptance.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. To the extent permitted by law, disputes shall be subject to the exclusive jurisdiction of the courts in Hannover, Germany.
If you are a consumer within the meaning of § 13 BGB, mandatory statutory consumer protections of your country of residence remain unaffected.
